Defendant insurance company is unnecessary to the opinion and will be ignored. Mrs. Callahan was run over and killed by defendant Van Galder's bus while she was crossing a street. By a special verdict
a jury found (1) that she had entered the crosswalk where she was struck before the bus entered it; (2) that she was negligent
in lookout, and (3) that her negligence was a cause of the accident. The verdict also found (4) that the failure of defendant
to yield the right-of-way to Mrs. Callahan was not a cause of the accident. It found (5) defendant was negligent in his lookout
but (6) that this negligence was not causal. The jury then apportioned causal negligence 75 per cent to Mrs. Callahan and
25 per cent to defendant.
