Two actions for wrongful death in the district court for Benton county, consolidated for trial and heard together on appeal, by the special administrator of the estates of Olga and Beatrice Blaske, resulting from a collision at a crossing between the auto in which decedents were riding and a passenger train of defendant railway company, operated by the defendant Clarence Green. The cases were tried before D. M. Cameron, Judge, and a jury, which returned a verdict in each case for defendant Green and one of $7,500 in each case in favor of plaintiff against the railway company. A special interrogatory submitted to the jury on the question whether the railway company was negligent in not having a flagman at the crossing at the time of the accident was answered in the affirmative. From an order in each case denying its alternative motion for judgment or a new trial, the railway company appealed.
